Tails Terms of Service

Tails and all associated services (the "Service") are provided by Angryamoeba ("us" or "we") subject to the terms and conditions below (the "Agreement"). By using and continuing to use the Service, you consent to be bound by this Agreement.

We reserve the right to modify this Agreement at any time without notice. In the event of any large changes, we will notify you at your primary email address or by displaying a notice to you the next time you log in to the Service. Modifications and additions to the Service itself are also subject to this Agreement. Your continued use of the Service after it has been modified will constitute your agreement.

Violation of any part of this Agreement shall be considered grounds for the immediate termination of your account.

Account Terms

1. You must be 13 years or older to use the Service.
2. You must provide your correct full name and a valid email address in order to create your account.
3. You are responsible for the security of your account and password. We will not be held liable for any loss or damages suffered if you fail to comply with this obligation.
4. You may not use the Service for any illegal or unauthorised purpose. In using the Service you must comply with the laws of your locale.
5. Your account may not be shared. Only one person may use each account.
6. You must be a human or other legal entity. Automated signups, whether in bulk or not, are forbidden.
7. It is not permitted for an individual to use or maintain more than one free account.
8. While we forbid certain types of Content and behaviour on the Service, you agree that we cannot be held responsible for the Content stored on the Service and as such you understand there to be a chance that you could be exposed to such Content. Use of the Service is at your own risk.

Payment, refunds and changes to your account

1. A valid credit card is required to use any of the paid accounts. You are not required to supply your credit card information to sign up for a free account.
2. If you initially sign up for a paid account, you will be billed on the same day the following month (or the last day of the following month, whichever is later) unless you cancel your account. You can cancel your account at any time from your account page.
3. If you hold a free account and choose to upgrade to one of our paid accounts, you will be asked for your credit card details and charged immediately.
4. The Service is charged in advance on a monthly basis.
5. The Service is non-refundable. There will be no refunds or credits for partially-used months of Service, nor will there be any refunds of upgrade/downgrade fees.
6. If you upgrade or downgrade from one paid account to another, you will be charged the new amount on your next billing date.
7. All fees are exclusive of taxes, levies or duties. It is your responsibility to pay these levies to the relevant taxing authority.

Cancellation of your account

1. You are solely responsible for closing your account. There will be no refunds for periods of time where your account has been open but unused. You can close your account from the "my account" page once you have logged in to the Service. An email or other notice given to us will not be considered an account closure.
2. When you close your account, all of your Content will be immediately and irreversibly deleted from the Service. Other users involved with your projects will not be affected and are responsible for closing their own accounts.
3. Once you close your account, you will not be billed for any future months of Service.
4. We reserve the right to suspend or terminate your account and refuse all future use of the Service, or any other Angryamoeba service, for any reason at any time. Such termination of Service will result in the deletion of your Content. We reserve the right to refuse service to any individual at our sole discretion.

Changes to the Service and Fees

1. We reserve the right to modify, suspend or discontinue the Service at any time with or without notice.
2. We reserve the right to change our monthly fees upon 30 days notice. Fee change notices will be displayed to you when you log in to the Service and on the Tails website at http://www.tailshq.com.

Copyright and Ownership

1. Angryamoeba (or its suppliers) own the intellectual property rights to all copyrightable components of the Service, including but not limited to the name of the Service, images and interface elements contained within the Service, CSS and Javascript files and related documentation. You may not copy, modify, adapt, distribute, dissemble, reverse engineer or decompile any aspect of the Service owned by Angryamoeba or its suppliers.
2. We claim no intellectual property rights over the information you submit to the Service. However by using the service to share information with others, you agree that others may view and share that information.

General Conditions

1. The Service is provided "as is" and "as available" with no representations or warranties of any kind, either express or implied. You assume sole responsibility and risk for your use of the Service.
2. Technical support is available only by email by contacting support at tailshq dot com.
3. You must not modify any other websites or documents so as to falsely imply association with the Service, Angryamoeba or any other Angryamoeba product or service.
4. You must not resell, reproduce or otherwise exploit any part of the Service without the express written permission of Angryamoeba.
5. We may remove Content and accounts containing material that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. However, we are not obligated to do so.
6. You must not use the Service for the purposes of sending unsolicited "spam" email or other messages.
7. Abuse (whether written, verbal, physical or otherwise) of any Angryamoeba client, employee or representative will result in the immediate termination of your Service.
8. Neither Angryamoeba, its affiliates or its sponsors be be held responsible or liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.
9. If any term or condition in this Agreement is determined to be invalid or unenforceable, the validity and enforceability of the rest of the Agreement shall not be affected.
10. If we fail to enforce any right reserved by us in this Agreement, that failure will not constitute a waiver of said right.
11. This Agreement represents the entire understanding between you and Angryamoeba. It supercedes any previous agreements between us including, most importantly, and previous revisions of this Agreement.
